By visiting our Site and/or purchasing something from us (including digital products, templates, quizzes, and online courses), you engage in our "Service" and agree to be bound by these Terms, including any additional terms and conditions and policies referenced herein and/or available by hyperlink.

These Terms apply to all users of the Site, including, without limitation, users who are browsers, customers, students, parents, and/or contributors of content.

If you do not agree to all the terms and conditions of this agreement, then you may not access the Site or use any Services. If these Terms are considered an offer, acceptance is expressly limited to these Terms.

Our Site is hosted on Kajabi, LLC, which provides the online platform that allows us to offer our digital products, resources, quizzes and courses to you. Payments may be processed by Stripe, PayPal, or other payment providers as indicated at checkout.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our Site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination, and/or we may deny you access to our Services (or any part thereof).

18. Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms and any policies or operating rules posted by us on this Site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including any prior versions of these Terms).

21. License to Use Digital Products, Courses and Materials (Non-Transferable License)

When you purchase or access any digital product, quiz, course, download, worksheet, template, or membership from QUEST Study Skills, you are granted a personal, revocable, non-exclusive, non-transferable licence to access and use the content for your own personal educational purposes only.

You must not:

• Share your login details with any other person
• Share, copy, redistribute, upload, or republish course materials
• Use any content for commercial, teaching, tutoring, or organisational purposes
• Modify or create derivative works based on any QUEST Study Skills intellectual property
• Upload our materials to any online platform, school system, learning management system, or cloud storage shared with others
• Feed, input, or upload any QUEST Study Skills content into artificial intelligence models, chatbots, or generative AI tools (including but not limited to ChatGPT, Claude, Gemini, or similar systems) for any purpose including training, fine-tuning, or generating derivative content

Any unauthorised sharing, copying, distribution, or resale of our materials is strictly prohibited. We reserve the right to suspend or terminate your access without refund if misuse or sharing is detected.

All content remains the intellectual property of QUEST Study Skills at all times.

22. Course and Program Access Duration and Renewal Terms

22.1 QUEST Study Skills Course and Program

When you enrol in the QUEST Study Skills Course and Program, you receive:

• 12 months of access from the date of purchase
• Course content and any future updates added during that 12-month period
• Optional monthly payment plan for enrolment (still granting full 12-month access once payments are completed)

After the initial 12 months:

• Students and parents may choose to continue access via subscription, billed monthly
• Subscription will be at a discounted "existing student continuation rate"
• Access will end if subscription renewal is not maintained

All access is conditional on adherence to the non-transferable licence terms above.

22.2 Mini Planning Course

Purchase of the Mini Planning Course provides:

• 1 year of access from the date of purchase
• Access to updates released during that 12-month period

After 12 months:

• Students may continue access by moving into a lower-tier monthly subscription
• Subscription is optional and can be cancelled anytime
• Access ends if subscription is not renewed

As with all digital materials, the licence is personal and non-transferable.

22.3 Applicability to Future Courses and Programs

The QUEST Study Skills Course and Program, and the Mini Planning Course are provided as examples of how access periods and subscription renewal options may apply to QUEST Study Skills digital offerings.

All access rules, licence conditions, subscription terms, renewal processes, and restrictions described in this Agreement apply equally to all current and future courses, digital programs, memberships, workshops, or learning materials offered by QUEST Study Skills, regardless of whether they are specifically named in these Terms.

This means that any future course or program you enrol in will be governed by:

• The non-transferable licence terms
• The access duration rules
• Subscription and renewal terms
• Coaching and mentoring disclaimers
• Intellectual property protections
• General Terms of Service included in this Agreement

Unless explicitly stated otherwise for a specific course at the time of enrolment, all future digital offerings operate under the same Terms and conditions outlined in this document.

22.4 Physical Products Listed for Information Only

From time to time, the QUEST Study Skills Journal may be listed on this Site for informational purposes only. The Journal is not sold directly through this website and must be purchased through third-party retailers or distributors as listed on the Site.

QUEST Study Skills is not responsible for:

• Retail store pricing
• Stock availability
• Shipping, returns or exchanges
• Retail store customer service policies

All purchase-related enquiries should be directed to the relevant retailer.

23. Subscription Terms and Recurring Billing

If you sign up for a subscription-based product, membership, or ongoing access plan, the following terms apply:

• You authorise QUEST Study Skills (via Kajabi, Stripe or PayPal) to automatically charge your chosen payment method on a recurring basis
• Billing occurs at the interval stated at checkout (e.g., monthly)
• Your subscription will continue until cancelled by you
• You can manage or cancel your subscription at any time via your account settings or by contacting [email protected]
• Cancellations take effect at the end of the current billing period
• Partial refunds for unused time or retroactive refunds for payments already processed are not provided

Subscription Price Changes

We reserve the right to adjust subscription pricing with at least 14 days' written notice sent to your registered email address. If you do not agree to the new pricing, you may cancel your subscription before the price change takes effect. Continued use of the subscription after the effective date of pricing changes constitutes acceptance of the new pricing.

24. Mentoring, Coaching and Early Access Support Disclaimer

From time to time, QUEST Study Skills may offer:

• Live Q&A sessions
• One-on-one mentoring
• Early access student feedback sessions
• Parent support calls or workshops

These services are designed for general academic skill-building and study strategy guidance only.

They do not constitute:

• Personalised psychological, medical, counselling, or therapeutic advice
• Individualised academic guarantee
• Tutoring services or diagnosis
• Legal or professional recommendations

Participants remain responsible for making their own decisions and seeking professional or school-based support where appropriate.

25. Refunds and Digital Access

All QUEST Study Skills products, including digital downloads, templates, quizzes, programs and online courses, are delivered electronically and provide immediate access upon purchase. Because digital content cannot be returned, all sales are final and non-refundable.

By completing your purchase, you acknowledge that:

• You receive instant access to the content, and
• You waive any right to request a refund or chargeback based on non-use, change of mind, or personal circumstances.

This no-refund policy complies with Australian Consumer Law for digital goods. Refunds will only be provided where required by law.

26. Intellectual Property and Anti-Plagiarism Clause

All digital products, course content, worksheets, templates, illustrations, videos, downloads, quizzes, written materials, and branding created by QUEST Study Skills are protected by copyright laws in Australia and internationally.

You agree that you will not:

26.1 Intellectual Property Relating to the QUEST Study Skills Journal
